Terms of Service

1. ✅ Acceptance of Terms

By accessing or using RestoMenu Pro at https://quickbites.online ("the Platform"), you agree to be bound by these Terms of Service ("Terms").

If you are registering on behalf of a business, you represent that you have the authority to bind that business to these Terms.

If you do not agree with any part of these Terms, you must not use the Platform.

2. 🍽 Description of Service

RestoMenu Pro is a Software-as-a-Service (SaaS) platform that enables restaurant owners ("Merchants") to:

• Create a branded online shop page with a unique URL
• Manage and publish menu items with prices and descriptions
• Receive and manage customer orders through an online dashboard
• Send order notifications via email
• Share order tracking links with customers

3. 👤 Account Registration

To use the platform as a restaurant owner, you must register an account. By registering you agree to:

• Provide accurate, complete, and current information
• Choose a URL slug that does not infringe on trademarks or impersonate another business
• Keep your password secure and confidential
• Notify us immediately of any unauthorised access to your account
• Be responsible for all activity that occurs under your account

You may only register one account per restaurant. Creating multiple accounts to circumvent plan limits is a violation of these Terms and may result in permanent suspension.

We reserve the right to refuse registration or suspend accounts at our discretion, including for accounts with misleading, offensive, or trademark-infringing names or slugs.

4. 💳 Subscription Plans & Billing

We offer the following subscription plans:

Billing: Subscriptions are billed monthly. Payment is due at the start of each billing period. Currently we accept manual payment methods (bank transfer, JazzCash, or other agreed method). An invoice or confirmation will be provided upon payment.

Plan upgrades: Upgrades take effect immediately upon confirmed payment and admin activation.

Plan downgrades: If you do not renew, your account will be downgraded to the Free plan at the end of the billing period. Your data will not be deleted but features will be restricted to Free plan limits.

Price changes: We reserve the right to change pricing with 30 days notice to existing subscribers via email.

5. 💰 Refund Policy

We want you to be satisfied with the platform. Our refund policy is as follows:

• Free plan: No payment, no refund applicable.
• First month: If you are not satisfied within the first 7 days of your first paid subscription, contact us for a full refund.
• Subsequent months: Monthly subscription fees are non-refundable once the billing period has started, except in cases of platform failure (extended downtime exceeding 72 hours).
• Service interruption: If we are unable to provide the service for more than 72 consecutive hours due to our fault, we will provide a pro-rated credit or refund for that period.

6. 🏪 Restaurant Owner Responsibilities

As a restaurant owner using this platform, you are solely responsible for:

• Menu accuracy: Keeping menu items, prices, descriptions, and availability up to date
• Order fulfilment: Accepting, preparing, and delivering orders placed through your shop page
• Food safety: Complying with all applicable food safety, hygiene, and health regulations in your jurisdiction
• Business licensing: Having all required licences and permits to operate a food business
• Customer communication: Responding to customers regarding their orders, complaints, and refund requests
• Customer data: Handling your customers' personal data in accordance with applicable privacy laws
• Accurate pricing: Honouring prices displayed on your shop page
• Payment collection: Collecting payment from customers directly — RestoMenu Pro does not process payments

RestoMenu Pro is not liable for any disputes between restaurant owners and their customers regarding food quality, order fulfilment, refunds, or any other matter.

7. 🛒 Customer Responsibilities

As a customer placing orders through a restaurant shop page on this platform, you agree that:

• You are providing accurate contact and delivery information
• Your order constitutes a binding agreement with the restaurant, not with RestoMenu Pro
• Payment terms, cancellations, and refunds are governed by the individual restaurant's policies
• RestoMenu Pro is not responsible for order fulfilment, food quality, or delivery
• You consent to your order information being shared with the restaurant for fulfilment purposes

8. 🚫 Prohibited Uses

You may not use this platform to:

• Violate any applicable local, national, or international law or regulation
• Impersonate any person, business, or entity
• Register a slug that infringes on another business's trademark or brand name
• Post false, misleading, or fraudulent menu items or prices
• Attempt to gain unauthorised access to any part of the platform
• Use automated scripts or bots to scrape, spam, or abuse the platform
• Transmit any malware, viruses, or malicious code
• Use the platform for any activity that is illegal, harmful, or offensive
• Attempt to circumvent plan limits by creating multiple accounts
• Resell or sublicense the platform to third parties without written permission

9. 🔐 Intellectual Property

Our platform: The RestoMenu Pro platform, including its code, design, branding, and all original content, is owned by Digitech Creative Marketing and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without written permission.

Your content: Menu items, restaurant names, descriptions, logos, and images you upload remain your property. By uploading content to the platform, you grant us a non-exclusive, royalty-free licence to display that content on your shop page for the purpose of operating the service.

Feedback: Any feedback, suggestions, or ideas you share with us may be used by us to improve the platform without any obligation to compensate you.

10. 🌐 Availability & Uptime

We aim to keep the platform available 24/7 but we do not guarantee uninterrupted service. Planned maintenance will be announced in advance when possible.

We are not responsible for downtime caused by:

• Third-party hosting provider (Hostinger) outages
• Distributed denial-of-service (DDoS) attacks
• Force majeure events (natural disasters, government actions, etc.)
• Internet infrastructure failures outside our control

Our target uptime is 99% monthly. If we fall below this due to our own fault, affected paid subscribers may be eligible for a pro-rated credit upon request.

11. 🔒 Termination

By you: You may close your account at any time by emailing support@quickbites.online. Your shop page will be taken offline within 24 hours. Your data will be deleted within 30 days per our Privacy Policy.

By us: We may suspend or terminate your account immediately without notice if you:

• Violate these Terms of Service
• Fail to pay subscription fees after a 7-day grace period
• Engage in fraudulent or harmful activity
• Receive repeated customer complaints about non-fulfilment of orders

Upon termination, your right to use the platform ceases immediately. We will provide a data export upon request within 14 days of account termination.

12. ⚖️ Limitation of Liability

To the maximum extent permitted by applicable law:

• RestoMenu Pro and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you for any claim arising from your use of the platform shall not exceed the amount you paid us in the 3 months preceding the claim
• We are not liable for losses arising from your reliance on the platform for business-critical operations without appropriate backup systems
• We are not liable for any disputes between restaurant owners and their customers

Some jurisdictions do not allow limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

13. 🏛 Disputes & Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan.

Any disputes arising from these Terms or use of the platform shall first be attempted to be resolved informally by contacting us at support@quickbites.online. We will make good faith efforts to resolve disputes within 14 business days.

If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of Islamabad, Pakistan.

For users outside Pakistan, nothing in these Terms affects your statutory rights under the laws of your own country.

14. 📝 Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes we will:

• Update the "Last Updated" date at the top of this page
• Notify registered restaurant owners by email at least 14 days before changes take effect
• Display a notice on the dashboard

Your continued use of the platform after the effective date of changes constitutes acceptance of the new Terms. If you do not agree with the changes, you must stop using the platform and may request account deletion.
